The Website is a platform that facilitates the online sale and purchase of branded merchandise and services offered by Zealthy's various affiliate/ registered merchants/ vendors/service providers at a discounted price ("Services"). The Services are offered to the Users through various modes which shall include, issue of coupons and vouchers that can be redeemed for various services. The purchase of products and services on the Website shall be governed by the Terms of Offer For Sale ("Terms of Offer For Sale"). Our website/portal is only operating as a ‘platform’ and it does not in any manner provide any services related to medical healthcare or lifestyles issues

3. Eligibility to Use

   1. The Services are not available to minors under the age of eighteen (18) or to any Users suspended or removed from the Zealthy system by Zealthy for any reason whatsoever. If You do not conform to the above qualification, You shall not be permitted to avail of the Services or use the Website. You represent that You are of legal age to form a binding contract and are not a person barred from receiving services under the laws as applicable in India. Notwithstanding the foregoing, if You are below the age of eighteen (18) years, You may avail the Services provided by Zealthy through Your legal guardian in accordance with the applicable laws.

    14. ZEALTHY DOES NOT PROVIDE ANY GUARANTEE AND SHALL NOT BE HELD LIABLE OR RESPONSIBLE FOR THE FAILURE TO SEND SMS OR OTHER NOTIFICATIONS OR REMINDERS TO YOU AS A FEATURE OF THE WEBSITE.

    15. Neither the HCPs, Labs nor Zealthy shall be responsible or liable for any breach or loss of data including Personal Information caused due to events beyond the control of HCPs / Zealthy or due to technical reasons or third party actions.

12. Indemnification

    You hereby indemnify, defend, and hold Zealthy, the Zealthy's distributors, agents, representatives and other authorized users (Registered and Non-Registered Users, HCPs), and each of the foregoing entities' respective resellers, distributors, service providers and suppliers, and all of the foregoing entities' respective officers, directors, owners, employees, agents, representatives, harmless from and against any and all losses, damages, liabilities and costs arising from (i)Your use of the Website (ii) Your breach of provisions of this Agreement and (iii) any negligent or intentional wrongdoing on Your part.

13. Violation of the Terms of Use

    1. You agree that Zealthy may, in its sole discretion and without prior notice, terminate Your access to the Website and block Your future access to the Website if Zealthy determines that You have violated these Terms of Use or Additional Terms. You also agree that any violation by You of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to Zealthy, for which monetary damages would be inadequate, and You consent to Zealthy obtaining any injunctive or equitable relief that Zealthy deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Zealthy may have at law or in equity.

    2. 14. Termination

    Zealthy reserves the right, in the event it finds out in its sole discretion that You breached the Agreement, to suspend and / or terminate Your user account and/or access to the Website by blocking Your IP address or email id with or without notice to You. Any suspected illegal, fraudulent or abusive activity may be grounds for suspending and / or terminating Your user account and/or Your access to the Website. Upon suspension or termination, Your right to use the features on the Website shall immediately cease and the Company reserves the right to remove or delete Your information that is available with the Company, including but not limited to login and account information.

    Upon user account termination or suspension, regardless of the reasons therefore, Your right to use the Website, User Content, HCP Content or Zealthy Content immediately ceases, and You acknowledge and agree that We may immediately deactivate or delete Your account and all related information and files in Your account and/or bar any further access to such files or this site. Zealthy shall not be liable to You or any third party for any claims or damages arising out of any termination or suspension of Your user account or any other actions taken by Us in connection with such account termination or suspension.

15. Governing Law and Jurisdiction

    The interpretation of this Agreement and the resolution of any disputes arising under this Agreement shall be governed by the laws of India.

16. Report Abuse

    In the event You come across any abuse or violation of these Terms of Use or if You become aware of any objectionable content on the Website, please report to Zealthy customer support

    The User hereby consents, expresses and agrees that he has read and fully understands the Privacy Policy of Zealthy in respect of the Website. You further consent that the terms and contents of such Privacy Policy are acceptable to You.

18. Communications

    1. You hereby expressly agree to receive communications by way of SMS, e-mails from Zealthy relating to Services provided through the Website.

    2. A User can unsubscribe/ opt-out from receiving communications from Zealthy through SMS and e-mail anytime by: Email support@zealthy.in to unsubscribe from messages/ SMS; and Newsletters sent daily at the registered email address by clicking on the unsubscribe option attached at the bottom of newsletter received through e-mail

19. General Provisions

Notice: All notices and other communications required or permitted hereunder to be given to a Party shall be in writing, in the English language will be served by email or by general notification on the Website.
